Quantum Field Academy Waiver and Release of Liability

This Waiver and Release of Liability (“Agreement”) is entered into by the undersigned (“PARTICIPANT” or “PARENT/GUARDIAN” if participant is a minor) in favor of Quantum Field Academy, LLC, its owners, members, managers, employees, staff, independent contractors, volunteers, instructors, affiliates, and any third parties associated with Quantum Field Academy (collectively, the “RELEASEES”).

1. Release of Liability

PARTICIPANT hereby releases, waives, discharges, and covenants not to sue RELEASEES from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained while participating in, observing, or otherwise being involved in any activity, program, or use of facilities associated with Quantum Field Academy, whether caused by negligence of RELEASEES or otherwise.

2. Assumption of Risk

PARTICIPANT acknowledges that athletic activities, including but not limited to baseball, weight training, conditioning, and other sports, involve inherent risks of serious injury, disability, death, or property damage. PARTICIPANT knowingly and voluntarily assumes full responsibility for all such risks, whether known or unknown, and whether arising out of the negligence of RELEASEES or otherwise.

3. Use of Facilities Not Owned by Quantum Field Academy

PARTICIPANT understands and agrees that activities may take place at facilities not owned, operated, or controlled by Quantum Field Academy, including but not limited to subleased spaces, public parks, and recreational fields. PARTICIPANT acknowledges that RELEASEES are not responsible or liable for the condition, safety, maintenance, or security of such facilities.

4. Supervision Disclaimer

PARTICIPANT acknowledges that while supervision and instruction are provided, RELEASEES cannot guarantee constant, individual, or direct supervision of all participants at all times. PARTICIPANT understands and accepts that accidents and injuries may occur despite proper supervision and instruction.

5. Medical Authorization

In the event of a medical emergency, PARTICIPANT (or PARENT/GUARDIAN on behalf of a minor) authorizes RELEASEES to obtain emergency medical treatment for the PARTICIPANT. PARTICIPANT agrees to be solely responsible for all costs associated with such treatment, whether covered by insurance or otherwise.

6. Indemnification

PARTICIPANT agrees to indemnify and hold harmless RELEASEES from any and all claims, damages, liabilities, attorney’s fees, court costs, and expenses that may arise out of PARTICIPANT’s participation or caused by PARTICIPANT’s actions, including claims brought by third parties.

7. Media Release

PARTICIPANT grants RELEASEES the irrevocable right and permission to use PARTICIPANT’s name, image, voice, likeness, photographs, or video recordings taken during activities for promotional, advertising, or publicity purposes, without compensation or further permission.

8. Parental Consent and Minor Participation

If PARTICIPANT is a minor, the undersigned PARENT/GUARDIAN acknowledges and agrees to the following:

• I am the parent or legal guardian of the minor PARTICIPANT.
• I consent to the minor’s participation in activities offered by Quantum Field Academy.
• I knowingly assume all risks on behalf of the minor, including injury, disability, death, or property damage.
• I release and waive any claims on behalf of my minor child, as though the child could legally do so.
• I agree to defend, indemnify, and hold harmless RELEASEES for any claims brought on behalf of the minor child.

9. Governing Law and Venue

This Agreement shall be governed by and construed under the laws of the State of Florida. Any legal action or proceeding shall be brought exclusively in the state courts located in Pinellas County, Florida.

10. Severability

If any portion of this Agreement is held to be invalid, the remaining provisions shall remain in full force and effect.

11. Acknowledgment of Understanding

By signing below, PARTICIPANT (or PARENT/GUARDIAN on behalf of a minor) acknowledges that they have read this Agreement in its entirety, fully understand its terms, and voluntarily agree to be bound by them. PARTICIPANT further acknowledges that they are giving up substantial legal rights, including the right to sue RELEASEES, and signs this document freely and voluntarily.
